Terms & Conditions

By making payment for any order either through Sanabakes.com or any of our social media pages, you are accepting the terms and conditions stated below.

These terms form the basis of the contract between our customer and Sana Bakes. These Terms, your Order and your Order confirmation are considered by us to set out the whole agreement between you and us for the sale of cakes. It is your responsibility to check all details in the order confirmation are complete and accurate as this is the document we work to when completing your order. 

Bookings, Deposits and Final Payment:

All of our unique, bespoke cakes are made to order which means we do not have fixed prices. Please contact us with your ideas and we will provide you with a quote.


We require a 50% initial non-refundable deposit to secure all orders. No contract is made with you until we have received your booking fee. Once your booking fee has been received you are in a legally binding contract with Sana Bakes.
We warrant that on delivery or collection the Cakes shall conform to their description as set out in the Order Confirmation, be of satisfactory quality and comply with all food safety, statutory and regulatory requirements in the UK and Canada.


We offer a range of cakes and also cater gluten free cakes, however all our cakes are baked and decorated in an environment where nuts are present. Unless specified otherwise cakes may contain or are made in an environment where nuts, milk, eggs, wheat, soya, gluten, lupin, sesame seeds, Sulphur Dioxide and other allergens may be present. We also cannot guarantee that any cake is entirely nut free although we make every effort to ensure that allergies are accommodated. Food allergy information is available on request. We cannot be responsible for any incidents involving personal food allergies.


Our cakes are quoted in inches and Serving size estimations are not guaranteed to be exact. Sana Bakes is not responsible for a shortage of cake at the event due to portion size. We cannot guarantee an exact replica of any cake, nor can we duplicate an exact copy of another cake artist’s work, but we will do our best to make it similar. Where colour swatches are provided, we will do our best to match as close as we deem possible. Exact colour matches are not guaranteed. Any samples, drawings, or descriptions we issue, and any descriptions or illustrations contained on our website are issued solely to provide you with an approximate idea of the cakes they describe and remain the property of Sana Bakes.


We will not be held responsible for customer disappointment of the design or the interpretation of the cake as long as it is made in line with the customer’s pre-agreed requirements set out in the order confirmation and will face no consequent liability. It is the customers responsibility to ensure all details within the order confirmation and sketch are correct and meet their exact requirements.

You are responsible for ensuring that all details in the order confirmation, including design sketches, are correct and meet your requirements. We are not liable for customer disappointment if the cake does not meet your expectations, provided it matches the pre-agreed design. Our warranty does not apply to defects caused by mishandling, negligence, or failure to follow instructions after delivery or collection.
The warranty does not apply to any defect in the Cakes arising from willful damage, accident, negligence by you or any third party, if you use the cake in a way we do not recommend, your failure to follow our instructions or any alterations you carry out.


The Client is responsible for providing a suitable environment for the cake (away from heaters, vibrations, people, suitable surface, suitable outdoor setting) and once the cake is collected or delivered by the customer Sana Bakes is not responsible for any cake damage including collapse, melting, pokes etc.
From time-to-time certain materials for our cakes may become obsolete. This is totally out of our control; however, we will do our best to select replacement products to reflect the original design as closely as possible. We reserve the right to replace items with component parts of equal or better quality without consultation.
Our cakes will occasionally include non-edible items on or in the cake. We’ll let you know which pieces cannot be eaten. It is your responsibility to ensure they are removed before serving. If your cake contains figures or florals made from sugar paste, whilst edible, we do not advise that they be eaten, due to the possible presence of dowels/wires for reinforcement.


If flowers are provided by an outside source, we will place them for an additional fee. You acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants and must be removed along with any floristry tape and wire before consuming the cake. Stacked cakes contain dowels in each tier to provide support and these should be removed before consumption.


The cake is a fresh product containing no additives or preservatives and it is our right to assume consumption on the day requested. Cakes should be stored in the refrigerator in an airtight container, away from direct sunlight and sources of heat, to ensure freshness. Sana Bakes and the customer expressly agree that the cakes and all goods purchased from Sana Bakes remain the property Sana Bakes until paid for in full.


Final payment is due 3 days before the order due date. We reserve the right to cancel the order if payment is late. If the client fails to make payments, Sana Bakes will cease work, the order will be cancelled, and no refund will be given. Preferred methods of payment are via Bank Transfer. The client will have a grace period of 24 hours after the payment date to pay debt before the contract is cancelled. Late payments and collections will be charged a fee. The full price of the cake will be as set out in your order confirmation.


If payment is not received by the date specified this shall be constituted as breach of contract by the client. We reserve the right to hold the order until payment is made in full. When payment is late, we accept no responsibility should we be unable to purchase the required stock or equipment to make the cake as laid out in the order confirmation. In these circumstances the cake will be made as close to the order confirmation as possible with no redress or liability on Sana Bakes. Any requests made 7 days before due date may be subject to rush order fees or full upfront payment instead of a deposit.


You may amend or cancel your celebration cake order by providing us with written notice within 4 weeks. Cancelled orders over 7 days of booking date will be refunded minus the deposit and any monies already spent on supplies. If a cancellation is requested after work has been started, there will be no refunds.
In the event of a cancellation by yourselves within 7 days of booking date full payment will be required.


In the case of alterations, a new order confirmation will be issued detailing the changes and the new cost. Alterations are not confirmed until a new order confirmation has been issued. Should you make any changes after that time there will not be a reduction in the price you pay, even if your new design is cheaper than the original booking. We will do our best to accommodate any changes to the order that are made 7 days before the order due date. and extra charges may apply to last-minute changes.
In the event of a postponement, subject to availability we will carry the monies paid forward to the new date. Please be aware that we will only do this on one occasion. Any further postponements will be classed as a cancellation.

In the unlikely event that we need to cancel your order any monies paid will be refunded. Sana Bakes reserves the right to cancel, vary or suspend the operation of this contract if events occur which are in the nature of force majeure including (without prejudice to the generality of the foregoing): fire, floods, storm, plant breakdown, strike, lock outs, riot, hostilities, non-availability of materials or supplies or any other event outside the control of Sana Bakes, and shall not be liable for any breach of contract resulting from such an event.

Some products may be available exclusively online, and their availability may be limited. We cannot guarantee that your computer monitor’s display of colours will be accurate. We reserve the right to limit quantities, refuse orders, or cancel orders at our discretion.
We reserve the right to refuse any order, including those that appear to be placed by dealers or resellers. You agree to provide accurate purchase information and to update your details as necessary.

Pick-up and Delivery

All orders may be collected free of charge from Sana Bakes by prior arrangement. We accept no responsibility for any damage sustained to the cake once it has left the premises.
If delivery has been requested, we will deliver the cake on the day set out in the order confirmation to the address provided. We do not offer specific delivery times. Sana Bakes will always do the best it can to ensure delivery dates agreed are achieved for the provision of the goods or services however the Company cannot accept liability for delays and time shall not be of the essence.
When delivering to a wedding venue, we will contact the venue in advance to arrange a mutually convenient time for delivery. If we set up the wedding cake, we shall take a photograph of the cake before leaving and, where possible, obtain a signature from the venue confirming the cake has been received in good condition. Should the venue need to set up the cake themselves we shall explain how the cake is to be displayed and where possible obtain a signature to verify we have done so.
Once the cake has been delivered, we are unable to accept any liability for any damage sustained to the cake thereafter nor any failure to follow the instructions provided.
If the cake is delivered with a stand/floral base, a security deposit will be payable with the final balance. The stand/floral base must be returned to us in a good, clean condition within 3 days of the wedding. Upon the return of the stand/floral base the deposit will be refunded.
The balance must be paid in cleared monies no later than the date set out in the order confirmation by bank transfer to the account specified. Late payments and collections will incur a £25/$25 charge.
Once an order is no longer in our care (delivered or collected) we take no responsibility for any damage caused.


Media
We reserve the right to use all photographs of the cake for advertising purposes. including web-based promotions, brochures, galleries and competitions.
Complaints:
Complaints are very rare and due to the amount of work put into each individual cake we take them very seriously. Any issues must be bought to our attention within 48 hours of collection or delivery to give fair opportunity to assess the nature of the complaint.

Both Parties agree to not post any negative information about the other arising out of this Contract or Event on any online forum or website without providing advance written notice of the intended content thereof, and providing the other party with a prior opportunity to resolve any issues between the parties amicably.

Complaints regarding the decoration of celebration cake can be easily repaired so errors of this nature must be pointed out upon delivery/collection so as to give us the opportunity to correct them. Once payment has been handed over this confirms that decoration is as requested and no further claims can be made.

Where the complaint is in regards to the quality of the cake then the cake, or remainder of the cake/tier, must be returned to us as soon as possible after cutting and within 48 hours of collection/delivery to ensure that we are able to fairly assess the nature of the complaint. Please note we can only deal with the client who placed the original order.


General conditions
Sana Bakes is not responsible for bodily injury, property or consequential damage, which may result from our services.
Sana Bakes is not responsible for any damage to the cake or shortage of cake caused by anyone not employed by Sana Bakes. Sana Bakes will not deliver a cake if payments have not been paid in full.


Sana Bakes is not responsible for any delay or inability to deliver based on accidents, natural disasters, transportation issues, inclement weather, illness, death, labor troubles, delay in supplies, disputes or strikes, or any other circumstance beyond Sana Bakes’ control.


If Sana Bakes has completed the cake but it can’t be delivered due to uncontrollable circumstances, the Client will be refunded 50% of the total cost. If the Client picks up the cake, Sana Bakes no longer assumes any responsibility for damage caused to it.


We reserve the right to refuse service to anyone for any reason at any time. Prices for our products are subject to change without notice. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libellous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.


Sana Bakes liability (both in contract and tort) in respect of defects in goods or services shall be limited to the issue of a credit note in respect thereof or granting a refund or other such compensatory measures as Sana Bakes at its discretion, considers appropriate in the circumstances and shall be limited to the to the value of the goods or services giving rise to the claim.


Sana Bakes shall not under any circumstances be liable for the customer respect of indirect consequential loss or damage or loss of profits, provided always that these conditions do not exclude or restrict Sana Bakes statutory liability for death or personal injury arising from any negligence on Sana Bakes part or liability imposed by statutory implied terms in Consumer Contracts.


All designs and intellectual property rights remain the property of Sana Bakes.
This Agreement together with Order Confirmation documents provided constitute the entire agreement and understanding between the parties relating to the order. Except as may be expressly stated in this Agreement, it supersedes and cancels all prior agreements, statements, representations, understandings, negotiations and discussions, whether oral or written, between the parties. Each of the parties acknowledges and agrees that in entering into this Agreement it does not rely on any statement, representation, warranty or understanding made prior to this Agreement save to the extent that such statement, representation, warranty or understanding is incorporated into this Agreement. Each of the parties acknowledges and agrees that in entering into this Agreement it has not relied on (or has been induced to enter into this Agreement by) any statement, representation, warranty or understanding made prior to this Agreement. Nothing in this paragraph excludes any liability for fraudulent misrepresentation.


The parties agree to submit to the non-exclusive jurisdiction of the English courts.
Any headings utilised in this Agreement have been inserted for the convenience of reference only and should in no way restrict or otherwise affect the construction of the terms and conditions hereof.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of United Kingdom.


By agreeing to these Terms of Service, you confirm that you are at least the age of majority in your jurisdiction, or that you have obtained consent from a parent or guardian to allow a minor to use the site. You agree not to use our products for any illegal or unauthorized purpose, and not to violate any laws in your jurisdiction, including copyright laws. You must not transmit viruses or destructive code.
We reserve the right to refuse service to anyone for any reason at any time. You acknowledge that your content (excluding credit card information) may be transferred unencrypted across networks, and that credit card information is always encrypted during transmission.


We are not responsible for any inaccuracies or omissions on this site. Any reliance on information from this site is at your own risk. Prices for products are subject to change without notice. We may modify or discontinue any part of the Service without notice.


We are not responsible for third-party websites linked from our site. You agree to review third-party policies carefully before engaging in any transactions.


Your personal information submitted via the store is governed by our Privacy Policy.
We may update or change these Terms of Service at any time, and it is your responsibility to check for updates. By continuing to use our site after changes are posted, you accept those changes.
